DEFINITIONS

Promoter: Mad Giveaways Ltd t/a Madtech Giveaways.
User: Any individual who visits and/or registers to the Promoter’s site.
Entrant : Any individual who enters a competition or giveaway.
Winner : An Entrant who is successfully picked at random.

 

OUR TERMS

1. THESE TERMS

1.1 What these terms cover. These are the terms which govern this site and the activities found within it. The Promoter has the right to amend these terms as they see fit at any time and without warning.
1.2 Why you should read them. Please read these terms carefully. All Users and Entrants will be bound by these terms. Any and all decisions made by the Promoter in relation to these terms will be final and binding in all respects. Users should read these terms each time they enter a competition and/or giveaway to check for any changes.

2. INFORMATION ABOUT US AND HOW TO CONTACT US

2.1 Who we are. We are Mad Giveaways Ltd t/a Madtech Giveaways a company registered in England and Wales. Our company registration number is 12879561. Madtech Giveaways is an online competition site. Users of this site have the opportunity to win items, in the form of a prize, by entering one of our competitions or giveaways, and correctly answering a question in order to be entered into the competition/giveaway draw.
2.2 How to contact us. You can contact us by writing to us at info@madtechgiveaways.co.uk .
2.3 How we may contact you. If we need to contact you we will do so by telephone or by writing to you at the email address or postal address you have provided to us.

3. REGISTRATION AND SITE USAGE

3.1 Account registration. Any person wishing to enter a competition or giveaway must first register for an account. In order to set up an account you must supply a valid email address and set a secure password.
3.2 Registration restrictions. In order to register you must be 18 years of age or over and reside within Great Britain.
3.3 Password requirements. In order to be a secure password, the Promoter suggests that passwords should include the following: both uppercase and lowercase, a number and a series of special characters .
3.4 Suspicious activity. The Promoter will not be held responsible for any account being hacked. Any suspicious activity should be reported to the Promoter immediately.
3.5 Unauthorized use. The Promoter is not responsible or liable for any financial losses, damages, identity theft or criminal activities caused by any unauthorized use of an account. Accounts should only be used by the registered User and solely for the purpose that this site is intended for.
3.6 Intellectual property. Users are not permitted to copy any text, layouts, or other such information found within this site. Any Users found to be doing so will be prosecuted under intellectual property law.
3.7 Mailing list. By registering to the site, Users will be added to the Promoter’s mailing list and will receive information and offers that may be of interest to them. Users will also be kept up to date with the progress of current competitions, along with draw dates, times and locations. If Users wish to be removed from this list they need to email the Promoter and they will be removed within 30 days.
3.8 Personal information. This site is designed to hold as little personal information as possible. Any information the Promoter does receive is solely for the purposes of conducting business as explained in these terms, for marketing and business monitoring purposes and for security and other legal requirements. Information is stored as securely as possible and only for as long as is necessary.
3.9 Data. The Promoter will take every effort to protect data, however the Promoter cannot be held responsible for any loss of data due to IT issues caused by, but not limited to, internet service providers, server hosts or online criminal activity. Full details regarding data and how the Promoter uses it can be found in the privacy and cookie policy. Users recognise and understand that the Promoter may and will use personal data, including contact data, as defined within the Data Protection Act 1998, that Users have supplied to the Promoter for the purpose of conducting competitions and website activities according to these terms.
3.10 Fraud and money laundering. Users are hereby made aware that the Promoter may, at its discretion or request of a third party, disclose personal information to third parties for the purposes of financial and or regulatory reasons and for the prevention of fraud and money laundering.
3.11 Use of the site. Users agree to use the site in the manner in which it is intended to be used. Any User who is found to be attempting to access secure areas of this site to cause damage or steal sensitive information will be reported to the relevant authorities.
3.12 Unacceptable behaviour. The Promoter will not tolerate any abusive, racist, or otherwise disturbing behavior. Any User found in breach of this policy will be permanently banned from the site.
3.13 Active accounts. Each person may only use one active account at any one time.

4. COMPETITIONS AND GIVEAWAYS

4.1 Entry restrictions. Competitions and giveaways are open to all Users, as long as the User is 18 years of age or over and resides within Great Britain. Any User that enters a competition is responsible for ensuring it is legal and law abiding to do so in their place of residence. The Promoter will not be held responsible for entrants entering a competition unlawfully. The Promoter and immediate family of the Promoter are prohibited from entering any competition or giveaway.
4.2 Competition details. Details of each competition can be found in the competitions details tab.
4.3 Ticket/entry numbers. Each competition will have a limited number of tickets/entries. The amount of entries for each competition will be at the sole discretion of the Promoter.
4.4 Minimum ticket requirement. Competitions may have a minimum ticket sellout requirement in order for the draw to be carried out. Where this is not achieved by the end of the competition run time Term 4.8 will automatically apply until the minimum ticket level is reached or the maximum time extension period has passed. The item will then be drawn and the competition conducted regardless of ticket sales.
4.5 Entry fees. The cost of entry will be at the sole discretion of the Promoter. All entry fees will become the property of the Promoter and will not be refunded or returned. A free to enter route is available for all competitions, please see below for full details.
4.6 Entry requirements – multiple choice question. All competitions and giveaways will have a question with 3 multiple choice answers. The question must be answered correctly in order for an Entrant to be added to the competition entry list. Incorrect answers cannot be changed, cancelled or refunded.
4.7 Competition closing date. Each competition will have a closing date that can be found on the competition listing. The competition will close when the listing time has elapsed or all available tickets have been allocatacted, whichever comes first. The Promoter has full discretion to close any competition early.
4.8 Extension of competitions. The Promoter can choose to extend any competition time by 7 days at a time, up to a maximum of 4 times.
4.9 Cancellation of competitions. The Promoter has the discretion to end and/or cancel a competition at any point and without warning. In this instance, the Promoter will refund Entrants their entry fee in full or exchange for tickets of equal value.
4.10 Prize. The Promoter will offer a prize for each competition and giveaway. The prize will be listed on the competition or giveaway page.
4.11 Entry list. Entry lists will be published no later than 10 hours before the relevant draw is due to take place and will be published on the winners/entry list tab of the website.
4.12 Numbers of winners. Each competition will have one Winner unless otherwise stated in the description.
4.13 Ticket number amendment. When entering a competition Entrants will receive a ticket number for each entry. The Promoter may amend Entrants ticket numbers prior to the draw if not all tickets have been sold, this is to aid in the draw process. The final entry list will be published no less than 8 hours before the draw with the final amended ticket numbers.
4.14 Giveaways. Giveaways operate under the same rules as competitions, however these are free to enter online. Each giveaway can only be entered once.

5. ENTRANTS

5.1 Terms and conditions. By entering a competition, Entrants confirm that they have read and understood these terms.
5.2 Identification. Entrants agree to produce identification when asked, if necessary, to ensure legal compliance and to protect the Promoter against fraud.
5.3 Maximum number of entries. The maximum number of entries per competition is 5 per User, unless otherwise stated in the competition listing. If it is found that an
Entrant has entered under multiple names or user accounts, all of that Entrant’s entries will become void. Users may enter multiple competitions at the same time.
5.4 Contact details. It is the sole responsibility of the Entrant to correctly enter a contact phone number, email address and postal address when entering a competition. The Promoter takes no responsibility for difficulty contacting Winners or Users due to incorrect contact information being submitted.
5.5 Receipt of entries. The Promoter takes no responsibility in the event of entries not being received as a result of computer system failure, Internet service provider issues, software or hardware failures or any other reason.
5.6 Use of Entrants names. By entering a competition or giveaway, Entrants consent for their name to be listed on the website and/or used in marketing information. Entrants also consent to their full name appearing on the entry list.
5.7 Postal entry. Users can enter any competition for free by postal entry. By providing a free entry route, the activities undertaken on this site do not fall under the definition of gambling under the Gambling Act 2005 and can take place without a licence. To enter via post, individuals are first required to register on the website Entries need to be sent on a handwritten, unenclosed postcard with a first or second class stamp to Madtech Giveaways, PO Box 2167, Hockley, SS5 9DN. Postcards must include the User’s first and last name, date of birth, email address, telephone
number, postal address, date of entry, the competition the User wishes to enter and the correct answer to the question. Only one entry per postcard is permitted, multiple entries under the same cover will only be counted once. Any unreadable entries will not be counted. Postal entries are processed on Monday evenings. Postal entries must be processed before the competition has closed. Any postal entries after this time will not be included. Any entries that do not comply with the criteria set out above will become void. The Promoter holds no responsibility for any loss of
personal information as a result of postal entries.

6. PRIZES

6.1 Prize details. All details regarding the prize are accurate and correct to the best of the Promoter’s knowledge. The Promoter holds no responsibility or liability for any financial losses or damages incurred as a result of any errors in the description. Entrants are required to carry out their own due diligence to ensure that they are informed of the correct details/specifications. 6.2 Prize property. All prizes are the sole property of the Promoter until the prize has been delivered to the Winner. The prize is the sole responsibility and property of the Winner once delivery is complete. At this point, the Promoter no longer has any responsibility or liability over the item. Any faults due to manufacturing issues, misuse or any other type of inherited faults or user faults will be the Winner’s responsibility. The Promoter has no liability in relation to any damage, injury or loss of money as a result of any issues or faults with the prize.
6.3 Prizes cannot be swapped. Prizes are as set out in the competition listing. Prizes cannot be swapped or exchanged. The Promoter holds the right to offer a cash alternative at the Promoter’s discretion.
6.4 Pre-order prizes. Pre-order prizes are items where the Promoter has secured a pre-order with a supplier. In the event that the pre-order is cancelled or delayed, the Winner will be able to exchange the prize for a cash alternative up to the RRP of the listed prize.

7. SELECTION PROCESS AND WINNERS

7.1 Random selection. Winners will be selected at random, from a list of all Entrants that correctly answered the competition question, using a third party online random number generator, such as google number generator. The number generator will randomly pick a number within the inputted number range. The Promoter will then match this number to the pre-published entry list. This will indicate the Entrant that has won.
7.2 Live draw. Winners will be selected during live draws held on one of the Promoter’s social media platforms. Entrants will receive an email informing them of the time and date of the draw, unless an Entrant has requested not to be contacted by email. The Promoter will also post the draw time and date on, but not limited to, the Promoter’s website, Facebook page & Instagram account.
7.3 Trial runs. The Promoter will complete a minimum of 3 trial runs using numbers outside of the number range of the pending draw.
7.4 IT issues during a live draw. In the event that a live draw is not able to take place at the scheduled time due to connection issues, power failure and other IT glitches, and/or there are issues during the live draw, the draw will be cancelled and will take place again in full once the issue has been resolved.
7.5 Contact with Winners. Once a Winner has been announced, the Promoter will try to contact the Winner via email and/or telephone to inform the Winner that they have won. In the event that the Promoter is unable to make contact with the Winner 7 days after the live draw has been carried out (this period can be extended at the Promoter’s discretion), the Promoter will select an alternative Winner.
7.6 Identification. Winners may be asked to submit identification to the Promoter to protect the Promoter against fraud and/or for legal due diligence. If any Winner is
unable or unwilling to provide identification, if required, that Winner will be disqualified. The Promoter will then pick an alternative Winner. An alternative Winner will be selected by the same method as stated within this policy from the original entry list. The alternative Winner will be bound by the same rules and restrictions as outlined in these terms.
7.7 Use of details. By entering a competition or giveaway, Entrants consent to being named as a Winner if successful. The Promoter may ask Winners for a photo to use on the website and/or in marketing information.

8. DELIVERY

8.1 Delivery requirements. The Promoter will only dispatch prizes once contact with the Winner has been made and confirmation of the postal address has been given. The Promoter reserves the right to refuse to send the prize to any other address other than the address listed on the User’s account.
8.2 Delivery outside of Great Britain. The Promoter will not arrange delivery outside of Great Britain.
8.3 Delivery company and method. The Promoter has the right to choose whichever delivery company and method it sees fit.
8.4 Proof of identity upon delivery. Winners may be required to provide proof of identity upon delivery. If the prize is unable to be delivered as a result of a Winner not being able to comply with this requirement, re-delivery and/or collection will be at the Winner’s responsibility and cost.
8.5 Failed delivery. The Promoter will only pay for the item to be delivered once. If delivery fails due to, but not limited to, an incorrect address and/or if no one is
available at the address to accept delivery, then any charges for redelivery will be at the Winner’s cost.
8.6 Collection. If the Winner chooses to collect the prize from the Promoter directly, or is required to collect it from the courier’s delivery center, this will be carried out at the Winner’s cost.

9. OTHER IMPORTANT TERMS

9.1 Contact details. Users are responsible for entering their details correctly when registering to this site or entering a competition. The Promoter is in no way liable for failure or inability to contact Users as a result of incorrect information.
9.2 Behaviour. The Promoter is in no way liable for unacceptable behaviour of any User and cannot be held accountable.
9.3 Closure/suspension of accounts. The Promoter reserves the right to close and/or suspend a User’s account if the Promoter feels the User is in breach of these terms.
9.4 Facebook. The competitions and giveaways on this site are in no way sponsored, endorsed, administered by, or associated with Facebook.
9.5 The laws which apply to this site. These terms, the competitions and giveaways on this site are governed by English Law. All matters and/or disputes will
be dealt with under English Law and the courts of England will have sole jurisdiction.
